This Week's Winners & Losers: Amazon Calls, Corinthian Falls

Redskins Cowboys Football AP/Tim Sharp There were plenty of winners and losers this week, with the leading online retailer introducing a smartphone and a former gold mine of a for-profit educator warning that it may have to drop out of school. Here's a rundown of the week's best and worst in the business world. YouTube -- Loser Billboard is reporting that Google's (GOOG) popular video-sharing website may be about to pull videos from a raft of indie bands. We're not talking about pirated tracks that were uploaded to the site illegally. These are the videos posted by legitimately by the musicians and their labels -- and they account for 10 percent of the music that YouTube has rights to feature. Seems that YouTube is getting ready to finally introduce a music subscription service, and if it hasn't been able to strike a music streaming deal with an artist, it doesn't want to give folks an incentive to sidestep its brand-new premium platform and just stream tracks for free off the site. This could get hairy: The list of indie artists at risk includes some biggies like Adele, Arctic Monkeys, and Vampire Weekend. Amazon.com (AMZN) -- Winner As expected, Amazon dove headfirst into the smartphone market on Wednesday with the debut of the Fire smartphone. The leading online retailer's hoping to raise the bar with features including unlimited photo storage, Firefly media identification, Mayday video support, and Dynamic Perspective that uses four cameras to provide a cutting-edge display that adapts to where the viewer's face is at any time. As a cherry on top, Amazon is offering Fire buyers 12 months of Amazon Prime for a limited time. Folks already paying for Prime -- and there are now tens of millions of them -- will get 12 months tacked on to their current memberships. That's a $99 value, making the device more affordable (and considering that Amazon priced it at about what an iPhone 5s goes for, some form of discount is a wise idea), but it also connects the owner directly into Amazon's lavish ecosystem. Washington Redskins -- Loser Dan Snyder has a problem. He owns an NFL team whose name is a racist slur against Native Americans. And while he insists that keeping the moniker is the best decision to maintain its decades-long tradition, it will become harder to hold that line in the future. In a surprising ruling by the Trademark Trial and Appeal Board, the team's trademark for its Redskins name has been revoked on the grounds that it's disparaging to Native Americans. The loss of the trademark doesn't mean the team will have to change its name right away, but if the ruling sticks it will make it that much harder for the team to go after makers of unauthorized goods bearing its name. It might have appeared Snyder had caught a break last month when the eyes of those looking to get racism out of sports turned away to follow Los Angeles Clippers owner Donald Sterling after his racist remarks. However, with the NBA getting tough and forcing Sterling to sell his team, the unflattering spotlight can turn back to the NFL, where Snyder has new financial considerations to weigh against the question of "tradition." Tesla Motors (TSLA) -- Winner It was a good week for the maker of high-end electric cars. Tesla stock jumped early in the week on reports that it would be teaming up with Nissan and BMW on charging stations and a charging standard. That was followed by a state bill passing in New Jersey that will allow up to four Tesla stores to open in the state where the company will be able to sell directly to consumers. Later in the week, it was Morgan Stanley chiming in with some high praise, calling Tesla "arguably the most important car company in the world." Corinthian Colleges (COCO) -- Loser When it comes to for-profit secondary educators, it seems as if Corinthian Colleges may be flunking out. The stock lost more than two-thirds of its value on Thursday after it revealed that it may have to shut down after the U.S. Department of Education moved to limit its ability to access federal student loans and grants. Corinthian Colleges has seen its enrollment shrink to just 75,000 students, and failing to provide student data to federal regulators isn't going to make the grade. For-profit education companies have been struggling in general due to iffy retention and student loan payback rates, as the government considers cutting off federal funds altogether to for-profit schools with high percentages of student loan defaulters or whose graduates' debt levels are too high in comparison to their incomes. However, Corinthian Colleges is making matters worse with its failure to comply with regulators after earlier allegations of faked grades and attendance records surfaced. .     Sales growth this last quarter was up only about 6%, but net income per share was up 21%. They pay a $0.60 dividend which gives them a dividend yield of 1.4%. Their cash flow yield is 4.6%, so they could easily raise their dividend. They are by far the leader in a very fragmented industry. I believe both [Vitamin Shoppe (NYSE: VSI  ) ] and GNC will do well and I think they may make a fair pairing in a portfolio. Stability versus growth.

    They do have $1.1 billion in debt. But they generate about $200 million in cash flow a year and they have $174 million in cash, so that shouldn't be a problem. Their cash flow is very high, so in my opinion, is reason enough to believe they will beat the S&P 500 over the next ten years.

    HONG KONG (MarketWatch) -- Hong Kong stocks swung between small gains and losses early Thursday after hitting a seven-month high in the previous session, with the Hang Seng Index (HK:HSI) down less than 0.1%.     I went out on a limb last week, and now it's time to see how that decision played out.

    I predicted that Apple (NASDAQ: AAPL  ) would close higher on the week. I felt that taking the stage for WWDC 2013 would give the consumer-tech giant the ideal opportunity to win back the market's waning interest in its products. The new cylindrical Mac Pro is cool. The iOS update is a welcome upgrade. There's even hope that iTunes Radio will be a game-changer in streaming. However, the stock actually sold off on the news. I was wrong. I predicted that the tech-heavy Nasdaq would outperform the Dow Jones Industrial Average. (DJINDICES: ^DJI  ) . This has been a tricky call lately, so how did it play out this time? Well, the market closed lower this week. The Nasdaq moved 1.3% lower on the week, but the Dow managed to close 1.1% lower. I was wrong. My final call was for Ulta Beauty (NASDAQ: ULTA  ) to beat Wall Street's income estimates in its latest quarter. The beauty-salon operator has been posting blowout quarterly results over the past year, and I was banking on seeing the trend continue. Analysts were looking for a profit of $0.62 a share during the quarter, and it came through with net income of $0.65. I was right.

    One out of three? Bummer! I can do better than that.

The Orlando, Florida-based company reported a quarterly loss of $19.3 million, or $0.14 per share, versus a year-ago profit of $42.2 million, or $0.32 per share. Excluding non-recurring items, the company earned $0.32 per share. Its sales surged to $1.6 billion versus $1.53 billion. However, analysts were expecting earnings of $0.30 per share on revenue of $1.6 billion. Equities Trading UP Conversant (NASDAQ: CNVR) shares shot up 30.25 percent to $34.79 after Alliance Data Systems (NYSE: ADS) announced its plans to buy Conversant for $35 per share. Shares of ULTA Salon, Cosmetics & Fragrance (NASDAQ: ULTA) got a boost, shooting up 17.69 percent to $114.72 after the company reported upbeat second-quarter results and raised its outlook. The company also unveiled a five-year plan for impressive growth. Sportsman's Warehouse Holdings (NASDAQ: SPWH) shares were also up, gaining 15.89 percent to $7.00 after the company reported stronger-than-expected fiscal second-quarter results.     Gilbert Carrasquillo/FilmMagic/Getty Images Beauty care has bucked the economic malaise in recent years, and Ulta Salon, Cosmetics & Fragrance (ULTA) is living proof. The chain that claims to be the country's largest beauty retailer -- salon products and services -- delivered blowout quarterly results on Tuesday. Net sales soared by 22.5 percent to $713.8 million, fueled by a healthy 8.7 percent increase in comparable store sales. The strong comps are on top of a 6.7 percent increase during last year's first quarter, and the average store is ringing up 16 percent more in sales than it was two years ago. Net income followed suit, rising 19.4 percent to $50 million or 77 cents a share. Analysts were only forecasting a profit of 74 cents a share. The Ulta-mate Sensation Wall Street is impressed. Wells Fargo (WFC) -- which already had a bullish outperform rating on Ulta stock -- issued an upbeat analyst note after the report came out. Wells Fargo is impressed by the strong traffic trend and robust margins. Ulta had pulled off a whopping 19 consecutive quarters of better-than-expected profitability before proving itself mortal with a miss last fall. It has now rattled off back-to-back beats to start a new streak. String it all together, and Ulta has beaten Wall Street income forecasts in 21 of the past 22 quarters. Cosmetics offer a relatively inexpensive mood boost in much the same way that movies do -- by bringing a little fantasy into your day. This is just fine for Ulta, as its stores stock 20,000 prestige and mass-market cosmetics, fragrance, hair care, skin care, bath and body products and salon styling tools. Its salons also offer services from head to foot. Beauty Knows No Boundaries Ulta is expanding quickly while smaller rivals are just going through the motions.     Another stock that's starting to move within range of triggering a big breakout trade is Sky-mobi (MOBI), which, through its subsidiaries, engages in the operation of a mobile application platform embedded on mobile phones to provide mobile application store and services in the Peo! ple's Republic of China. This stock has been red hot so far in 2013, with shares up a whopping 88%.

    If you look at the chart for Sky-mobi, you'll notice that this stock recently formed a triple bottom chart pattern at $3.31, $3.28 and $3.40 a share. That bottoming pattern occurred over the last two months. Shares of MOBI have now started to uptrend and flirt with its 50-day moving average of $3.76 a share. That move is quickly pushing MOBI within range of triggering a big breakout trade.

    Traders should now look for long-biased trades in MOBI if it manages to break out above some near-term overhead resistance levels at $3.71 to $3.83 a share with high volume. Look for a sustained move or close above those levels with volume that hits near or above its three-month average action of 145,934 shares. If that breakout triggers soon, then MOBI will set up to re-test or possibly take out its 52-week high at $4.96 a share. Any high-volume move above that level will then give MOBI a chance to tag its next major overhead resistance levels at $5.55 to $6.13 a share.

    Traders can look to buy MOBI off any weakness to anticipate that breakout and simply use a stop that sits right below some key near-term support levels at $3.40 to $3.28 a share. One can also buy MOBI off strength once it takes out that breakout levels with volume and then simply use a stop that sits a comfortable percentage from your entry point.

The Court�� decision to sustain the constitutionality of the whole of Section 5000A under the taxing power necessarily disposes of Sissel�� Commerce Clause claim.

    Manulife Financial (MFC) is another stock that's forming an ascending triangle pattern right now. In the case of this $33 billion Canadian financial services firm, resistance comes into play at $18, a price level that's acted as a ceiling for shares since all the way back in July. The buy signal comes on a move through that $18 barrier.

    Whenever you're looking at any technical price pattern, it's critical to think in terms of those buyers and sellers. Triangles, and other pattern names are a good quick way to explain what's going on in a stock, but they're not the reason it's tradable. Instead, it all comes down to supply and demand for shares.

    That $18 resistance level is a price where there has been an excess of supply of shares; in other words, it's a place where sellers have been more eager to step in and take gains than buyers have been to buy. That's what makes a breakout above it so significant -- the move means that buyers are finally strong enough to absorb all of the excess supply above that price level.

    After it happens, I'd recommend keeping a protective stop at $16.50.

The pharmacy chain will join 17 other large employers on the Aon Hewitt Corporate Health Exchange as part of a growing movement to offer employees fixed dollar amounts to purchase their own plans on such exchanges. The end-cost to employees depends on the plan chosen, but they typically get more options than under traditional arrangements. Private exchanges mimic the coverage mandated as part of the Affordable Care Act. Enrollment in the public exchanges starts Oct. 1. "What happens to employer contributions over time? Will they put in as much as they put in the past? These are unanswered questions but potential negatives," says Paul Fronstin, a senior research associate with the Employee Benefit Research Institute. The benefit to Walgreen and other employers is unknown at this point, as their cost-savings aren't clear. Of the 180,000 Walgreen (WAG) employees eligible for health care insurance, 120,000 opted for coverage for themselves and 40,000 family members.     Unfortunately for me, Twitter is taking advantage of a new rule that allows US companies with less than a billion dollars in revenue to file for their IPO confidentially. This hinders analysts, everyday investors and the press from digging into Twitter's financials or business strategy until shortly before the company's stock-market debut. Until I can see real numbers, I'll have to be satisfied reading the industry scuttlebutt and thinking about where Twitter's business may go in the coming years. Henry Blodget from BusinessInsider.com wrote just such a piece, referencing research from Wall Street analyst Robert Peck. It seems Twitter is expected to go public with a market capitalization of about $20-billion (US), which would represent 17 times next year's revenue estimate. This means, analysts think, admittedly based on very limited information, that Twitter will do about $1.2-billion in revenue in 2014. This seems like a crazy high multiple, until you realize that both Facebook and LinkedIn have gone public with similar forward revenue multiples, and both are posting excellent annual growth, which could justify their valuations.

    There's nothing all that unusual in the pension problems facing Girl Scouts of the USA. Plenty of private companies and public-sector employers are dealing with the same issues and have had to take similar steps to shore up their pension finances. Like the GSUSA, IBM (NYSE: IBM  ) and Verizon (NYSE: VZ  ) froze their pension plans several years ago, as both companies decided that reducing the unpredictability of pension benefits made the most sense for them in managing their risk. More recently, Verizon and General Motors (NYSE: GM  ) took even more dramatic steps to limit pension risk, outsourcing substantial portions of their respective pension liabilities to insurance giant Prudential (NYSE: PRU  ) .     Big Moves Are Reshaping Baxter

    Baxter shares have risen 6.8% year-to-date, below the S&P 500�� 7.6% gain. But even though the stock hasn�� caused a lot of buzz with investors, management has made a number of important moves in the past two years.

    The first came in late 2012, when the company acquired Gambro AB for US$4.0 billion, marking the biggest acquisition in its 83-year history. Sweden-based Gambro makes dialysis products for patients with acute and chronic kidney disease. The company is the world�� second-largest manufacturer of dialysis machines, after Germany�� Fresenius.

    Baxter already had a presence in the dialysis market but mainly focused on in-home equipment, while Gambro�� products are mostly used in clinics.

    This is a large and growing market for the company: according to the Baxter, approximately two million people worldwide are on some form of dialysis, and that number is growing by more than 5% annually due to rising rates of diabetes and hypertension.

    But, this concern isn't just relegated to Walgreen. Rite-Aid (NYSE: RAD  ) , for instance, only recently recorded an annual profit in fiscal 2013 -- its first such annual profit since 2006! Rite-Aid's problems flow from two fronts: weaker store traffic and extremely high debt levels, which weigh down its strategic options. Even the bigger CVS Caremark (NYSE: CVS  ) is having its own set of problems. In the first-quarter it delivered a pharmacy same-store prescription increase of 2%, but saw pharmacy same-store sales dip by 1.4% because of more generic prescriptions being filled. This is a low-margin sector, so anything that can drag down margins can dramatically affect these stocks.

South Texas

These assets consist of approximately 1,445 miles of pipeline ranging in diameter from 2 inches to 20 inches with an estimated design capacity of 590 million cubic feet per day. Its South Texas region also includes 29 compressors with total compression of approximately 35,000 horsepower, two processing plants with total processing capacity of 185 million cubic feet per day and contracted third-party processing capacity of 83 million cubic feet per day, two treatin! g plants and one fractionator. During 2011, the systems in this region had an average throughput of 379 million cubic feet per day, including the processing plants, which processed an average of 75 million cubic feet per day in that period. It divides its South Texas region into four asset systems Vanderbilt and Gulf Coast gathering systems, which it refers to collectively as the Gulf Coast system; CCNG Transmission, which refer to as the CCNG system; Gregory gathering system, Gregory processing plant and Gregory fractionation plant, and Conroe gathering system and Conroe processing plant.

The pipelines in its South Texas segment are connected to multiple producing fields, including the Eagle Ford shale area. In addition to tie-ins to its two processing plants, its gathering systems are also connected to two processing plants owned by third parties and to a range of intrastate and interstate pipelines.

The Gulf Coast system is located throughout 13 counties in South Texas, including parts of the Eagle Ford shale area, and consists of two pipeline systems. The Gulf Coast system includes approximately 743 miles of pipeline ranging from 2 inches to 20 inches in diameter with an estimated design capacity of 205 million cubic feet per day. The system also includes seven compressors with compression of approximately 7,136 horsepower on a combined basis. During 2011, this system had an average throughput of approximately 114 million cubic feet per day.

The Gulf Coast system acquires natural gas from over 100 producers at prices that are at a fixed discount to the Houston Ship Channel Index price. The gas is delivered to third-party processing plants, including the Formosa processing plant located in Point Comfort, Texas and the Hilcorp processing plant located in Old Ocean, Texas. In the case of the Hilcorp processing plant, its customers pay it gathering fees to transport approximately 25 million cubic feet per day from their wells to this processing plant. Its producer ! customers! on the Gulf Coast system range from small independent exploration and production companies to producers, such as Chesapeake Energy and Devon Energy.

The CCNG system is located in the Eagle Ford shale area and consists of over 417 miles of transmission and gathering pipeline ranging from 2 inches to 20 inches in diameter. The system also includes one compressor with total compression of approximately 1,260 horsepower. During 2011, the system had an average throughput of 190 million cubic feet per day. Natural gas is supplied to this system from approximately 35 field receipt points, treating plants and third party gathering systems and pipelines, including Texas Eastern, Kinder Morgan and Conoco Lobo. Producers who supply or transport natural gas on the CCNG system include Swift Energy, EOG, Exxon, Comstock and Apache. Liquids-rich gas can be transported from the western end of the system to its Woodsboro and Gregory processing plants. Dry gas is brought into the dry gas portions of the system along with residue gas from the outlets of its processing plants. Gas in the system is purchased and sold, under fixed-spread arrangements, as well as transported on behalf of shippers. The CCNG system sells its dry natural gas in the industrial market around the city of Corpus Christi. A portion of the throughput on its CCNG system is processed at its Gregory processing plant or at the Formosa processing plant located in Point Comfort, Texas.

The Gregory gathering system is located near Corpus Christi, Texas and consists of approximately 266 miles of pipeline ranging from 4 inches to 18 inches in diameter. The system also includes one compressor. Its Gregory processing plant is a cryogenic natural gas plant comprised of two units collectively having a total capacity of 135 million cubic feet per day. Its Gregory processing plant processes natural gas from the Gregory gathering system, as well as gas originating in its CCNG System.

Produced NGLs are fractionated in the Compan! y�� fra! ctionator located on the same site as the Company�� Gregory processing plant. Purity ethane is shipped through pipeline to Dow Chemical while remaining NGLs are shipped through truck to local markets, which yield a premium to available pipeline rates. All of its customers on the Gregory gathering system pay a flat fee for natural gas to be gathered in the system and processed at the Gregory processing plant. Its Conroe processing plant is a 50 million cubic feet per day cryogenic natural gas plant. The plant recovers approximately 65% of the ethane contained in the inlet natural gas, depending on loads and temperatures.

Mississippi

The assets in the Company�� Mississippi region are located in the southern half of the state and comprise the intrastate pipeline system in Mississippi. The Mississippi assets consist of approximately 626 miles of pipeline ranging in diameter from 2 inches to 20 inches. The Mississippi system also includes two compressors. During 2011, the system had an average throughput of 86 million cubic feet per day. It generates revenues from its Mississippi assets by charging fixed transportation fees to shippers and by entering into fixed-spread contracts with suppliers and power generation, industrial and utility customers. During 2011, fixed-fee transportation contracts comprised 34.8% of the volumes it transported on its Mississippi system and fixed-spread contracts comprised the remaining 65.2% of its volumes.

Alabama

The assets in the Company�� Alabama region are located in northwest and central Alabama and consist of 519 miles of natural gas gathering pipeline ranging from 2 inches to 16 inches in diameter. The Alabama system also includes 22 compressors with total compression of approximately 24,537 horsepower. The system has an estimated design capacity of 375 million cubic feet per day. The gas supply to the system is coalbed methane gas from the Black Warrior Basin with incremental volumes gathered from conventional ! gas wells! . It gathers, transports, compresses, purchases and sells natural gas in Alabama and offers both intrastate transportation and interstate transportation services. During 2011, 81% of the volumes on its Alabama system were transported pursuant to fixed-fee transportation contracts and 19% of the volumes on the system were purchased from producers and then transported and sold to power generation, industrial and utility customers pursuant to fixed-spread contracts.

    In the world of publicly-owned businesses, we try to invest with the same sort of individuals. In our opinion, Michael O'Leary, Ryanair's Chairman and CEO, is one such example of a talented, driven executive. Michael was born on a farm in Ireland, the second oldest of six siblings. Although his beginnings were not remarkable, Michael figured out how to get the best education he could by attending the best schools he could. Advisers who are salivating over big IRA rollovers from new clients: Watch out. The IRS has a bull's-eye on those dollars.

Starting Jan. 1, the Internal Revenue Service will begin enforcing a rule permitting only one 60-day IRA-to-IRA rollover every 365 days, regardless of how many IRAs a taxpayer owns. The finding runs contrary to the IRS' own interpretations of the tax code, as the agency has indicated that taxpayers can do one rollover annually for each account, according to a legal blog posted on tax guru Ed Slott's website.

“You can only do one rollover a year, and that's very concerning to us,” said Robert S. Keebler, partner with Keebler & Associates. “Financial advisers need to be on their toes.”

At last check, POWI closed a bit off its intraday high and volume was well above its three-month average action of 218,547 shares.

    Traders should now look for long-biased trades in POWI as long as it's trending above Wednesday's low of $52.60 and then once it sustains a move or close above Wednesday's high of $55.59 with volume that this near or above 218,547 shares. If we see that move soon, then POWI will set up to enter new 52-week-high territory, which is bullish technical price action. Some possible upside targets off that move are $60 to $62.
